  • For the most part, BY LAW, both drivers are at fault for t6he accident. THe law states that if you are not legal to be on the road, you should not be. So if you were not there, the accident would not happen. As for the car damages...hope the guy at fault (whether either was supposed to be on the road or not) has a conscience or it could wind up in court.
  • Both drivers should be cited for lack of auto insurance, if its required in your state. not having auto insurance and being at-fault, will eventually end in civil court, with the at-fault driver being sued for damages. you will need an attorney.
  • it becomes a cival matter a lawyer is needed
