  • I believe so, if both types are to be illegal. On the premise that harm is indisputably done to the subjects depicted in the child pornographic images, we can assume that soft-core depictions will not do so much harm as hard-core depictions. For example, nude or partially nude posing vs. sexual intercourse or graphic sexual activity. It doesn't make sense to give a blanket punishment to perpetrators of a crime whose offenses run gamut of possibilities in relation to harm done to the child victim.
  • There are all sorts of nude photographs of children that are considered fine art, I'm thinking black and whites from major photographers of decades past. . Consider this case, for example: http://www.jstor.org/pss/777319 . Google Jock Sturges' work and judge for yourself. I'm not seeing it as pornography, not even soft-core pornography. However, if one defines porn as 'something that sexually excites someone' then he's a pornographer. As was Michelangelo.
