  • I am not from the US, but the short answer in Australia is that if you are sub-letting then the you will need the landlord's written consent. For example - if your room mate is a border, (has his/her own room and shares the common areas with you), the answer is yes. If your "room mate" is your partner or spouse, then I would say look at it as though you are getting married and you do not need your landlord's permission to get married (although I have heard of some who believe they have that right).
