  • I think this is a tricky question, because to find guilt with the state, you first have to know if the inmate had guilt himself in the action. As a former inmate, I know that many times prisons are ignorant of the rules they set, and sometimes they are at fault when crimes are comitted against other inmates. But there are times where ironically the prison cannot be at fault. Yes guards are there to help control and keep the peace, but they can't be everywhere. This can be pretty delicate, and I do agree that there are times where the state should be responsible, but there are also times when inmates get themselves in trouble. That is not ignoring the safety of inmates, as I was one myself, but it all depends on the situation.
