  • If he's on there as an authorized user, you're pretty much screwed. Sorry.
  • Sounds like you are going to divorce. Ask for the money in the settlement or if you reported the cards stolen, let them figure out it is him and take him to jail or make restitution.
  • Been there, done that. The court may be able to make a finding that it occured after separation and he is liable. Unfortunately, getting the credit card companies to stop if the cards were obtained while you were married and/or he is an authorized user is slim to none. Try and get it back in the divorce settlement, if possible. In the end, I ate the $50,000 my ex and his family forged into my name (fake new credit accounts as well) just to be finished with the divorce. GOOD LUCK!
  • Being separated does not count. he still has a 50% right to use the cards. Only until you are divorced, can the situation with the credit cards, be settled in divorce court.
  • There's not enough information here to give you a concrete answer. What state are you in? Are you legally separated? Was the account opened before or after the separation? How was he able to run up the bill if the card has only your name on it?
  • Is he an authorized user? If not, your husband committed larceny or fraud (or both depending on the state). What you need to do is file a police report and then forward it to the credit card company. You are only responsible for $50 of fraudulent charges. If your husband is an authorized user, then there is nothing the credit card company can do against him. However, once you are legally separated, your income and debts become separate. Thus, when you divorce you can get reimbursed for the charges made by your husband.
