Is the HOA responsible for termites in my condo? The by-laws don't say anything about termites.

Some do and some don't it all depends what the CC&R's say.

It would state in the C.C. &R's. If a true condo good chance, if a PUD, hard to say.

Do the by-laws supercede the rules & regulations of a HOA? I know that by-laws can only be changed by a homeowners vote but rules & regulations can be created by the board. What if the rules conflict with the by-laws?

Our unit was built in 1975 and no fumigation of units for Termites have been undertaken, although termites do exist. Can we force the HOA to schedule the fumigation or is it at their dicretion?
