Yes, all states use eminent domain, and the Constitution requires that you be paid fair market value. Maine (along with 7 other states) do have a statute that prevents the government from using eminent domain for commercial purposes. In other words, they cannot buy your home and then sell it to a developer to build a shopping center. But they can buy you out and build a park, a stadium, a road, or anything else that will be owned by the government (or for the general public).
