Although it is not clear from your question, I am going to assume that you and the mother were never married. If this is the case then you would have to file where the mother resides. If you were married to the mother and the current custody was determined by a family court, then a change in custody will go back to the court. In other words, if you were divorced in Nevada, then you could file in Nevada.
