Not exactly sure what your question is. But HOAs do not usurp rights. You, as a buyer, agree to the rules of the HOA when you purchase your property. Granted, some management companies get carried away, but you should complain to the board about that. If you are talking about one association that governs condos, townhouses and detached houses, I would think it IS likely that there could be different rules.

Short answer: Yes, there are different rights for condo, townhouse, and single family homeowners with respect to Home Owner Associations (HOAs). Longer answer: The HOAs develop sets of Rules and Regulations that apply to owners and occupants of the property. These rules and regulations are set up to help provide general tranquility for group living, which of course diminishes or removes all or some of the rights a property owner would normally have. Therefore, this is not truly a usurpation of rights, but moreover simply just an agreement to sacrifice some of the rights one would have for the sake of the community. --ProAnnouncer

I have to say, that I live in a townhouse community and I absolutely hate my HOA. They have screwed me over so many times. They had our houses treated for termites and a month later they sent us a bill for $900. It sucked. I didn't even have a choice in the matter, they pretty much just kicked us out of our houses for 2 days and then sent us a bill for it a month later. Friggin A Holes.

It seems everything is in the hands of the board members. I have made several complaints to my property manager about the lack of grounds maintenance, in which I was ignored. Then I contacted our local Code Enforcement Officer to see if I could report the excessive dog feces on our grounds. Still waiting to hear back from her, but the property manager's assistant contacted me after I made a general complaint to their e-mail, and she told me it really is up the whether the board members care enough about your complaints to actually do something about it. They also refused to tell me who the property owner(s) is/are that they manage the property for, because it was "private information", so you are basically SOL, since the property owner(s) will never know they hired a crappy property management company to over charge for under managing. I will never own another residence again that has HOA. I could save 3/4 of the $175.00 per month I pay in HOA fees and care for my grounds at a house 100% better that I get at my condo, and it would cover the water bill as well and cost less. Money grubbing Jerks!!!
