As indiscriminate as it is proposed to be, the selections of the panel members made by the Commander in Chief is indicative of his/her opinion and therefore will likely result in more cases ruling in favor of the aforesaid Chief's opinion... making it discriminate, unfortunately.

I think that the justices have far too much of an "interpretive" way of making decisions. The constitution was written in English, not an alien language from outer space that needs to be "interpreted." The Supreme Court has become too political.
