Technically, that would be the executive branch. As a practical matter, the VP is on the branch first sawn off when a major scandal occurs.

In their capacity as Vice President, the Executive Branch. However, since the VP of the current U.S. administration holds not only that title, but also fills the seat of the President of the Senate, that places him in the Legislative branch as well. For all legal intents and purposes, someone holding both offices is subject to all duties and obligations of *Both* offices at any given time.

Although the Executive Branch seems the obvious answer, the VP has no powers in that capacity unless the President is out of commission. The VP is the President of the Senate and is able to cast votes in the case of a tie, so that would lend credence to the assertion that the VP is in the Legislative Branch.
