  • You have the right to have damages to your car repaired and any medical bills that are a direct result of the accident covered, less the deductables. First, I trust your boys were properly restrained with either booster seats or seat belts, depending on their size, age and weight. If you truly believe the occupants of the other car switched positions, you should have stated such to the police on the scene. They will investigate that matter. If the other driver didn't have insurance, you can sue him for the damages, but your right is to be made whole. No less, no more.
