Is it legal to rent my home for a higher rent and credit the renter(and perspective buyer) with the non refundable overpayment IF he decides to buy the house within an agreed upon period of time -- all specified in the a contract?

As long as it is in a contract, signed and witnessed then Yes. Without a contract any partie could argue against the cause. -
