  • I would just let the car driver's and farmer's insurance companies get on with sorting it out.
  • It's the same liability as with horses and dogs. It's the farmer's responsability becuase it was his cow and he should have maitained the fences so the cow wouldn't have gotten out. What is really not fair is this applies even if someone else let them out and the farmer had no idea someone busted his fence down.
  • Bottom line is the farmer is liable for all damages. But, a farmer cannot be with his animals 24/7. Best bet is to let the damaged car insurance pay for damages to the vehicle. farmers are not rich people.
  • I'm afraid it is always the farmers responsibility because animals are considered property and property is the responsiblity of the owner. It never is given free will. It wa the farmer's fault for not secruing his property, the cow. In a bit different vein, I had a friend who ws riding a horse across a road when a car came and hit the horse and rider. The car's driver was not held liable for the death of the horse becuase it was considered her property and she hadn't 'ssecured' the property safely and had it in the road! I couldn't believe it!
