The prosecution must prove the offence beyond reasonable doubt in a criminal prosecution.
The prosecution has the burden of proof.
prosecution. You are innocent until they prove you guilty, then if you are a thug you might get out of prison, if you are an honest tax paying law abiding citizen they might keep you in, especially if you happen to have hurt a burglar caught stealing in your home.
BTW, the burger will have a state paid lawyer to fight you, you might have to pay out of your own pockets.

The claimant. Coz' the claimant is the one making a claim. Once they have satisfied the burden, depending on the evidence and how the case unfolds, the burden of proof will shift to the defendant.
can one judge dismiss a tpo, 20 days after another judge issued and signed a tpo because the defendant filed for divorce?
