Death certificate (uncle's) and identifying papers that show that your mom's the nearest living relative (I assume she is the sister) Should be presented to the bank manager. Those identifying papers (For her) would be her driver's license (picture ID) and her wedding certificate (if she has her spouses - your fathers - last name). They in turn may accept these or they may request other papers. Most (not all) banks will work with the relatives of the deceased.

Laws vary by state, but in most states your uncles estate will need to go into probate. The reason for this is that creditors may have a right to the money, as will any other next of kin (if applicable).
