I believe it will go like this: the death penalty statute which was in effect at the time of Manson's crimes was overturned as unconstitutional, so that his death sentence could not be carried out. Later, a death penalty statute was enacted in keeping with the Consitutional guidance of court decisions. Only capital crimes committed since that statute went into effect can be punished by death. A law can not be applied to anything done before its passage. That is known as "ex post facto" and is prohibited by the US Constitution.

I think what a waste of almost forty years our country has wasted money considering there are normal people that don't even have food to eat yet this man has a nice warm jail cell,probably cable tv,food & a social life with pen pals. Obviously, this man had a long track record of problems before he executed these deaths when I was three years old, what can they possibly learn from this psycho to keep him here? Have they studied Manson to figure out what causes some one to be evil? I think by them keeping him alive all these years they showed America that no matter how evil & horrible you are the law still will protect you that really helps all of the innocent people that want a violent free life. You answer your own question.

Absolutely! He's been trying to go on parole for a while now and I tell ya, if that whack job ever gets out, he'll do it all over again, particularly today when there's so much fresh brain to draw from
