I paid a retaining fee to a buyer-broker, we have not been happy with his level of work. Can I go with another agent to buy a house or do I have to stay with the buyer-broker?

    Check your written agreement. Sometimes brokers will have a 90-day clause in your agreement which is stuck by in the industry. If you have signed this, no other broker will work on your behalf until the date of expiry.

    Your best course of action would be to tell the buyer-broker you are unhappy with him and ask for a release from the contract. Go to this meeting prepared with all the reasons you are requesting the release and make sure they are more than "I just don't like you." Is he non-responsive to your needs, your schedule, etc.? Have you missed out on deals that have come on the market because he is not paying close enough attention? In most cases, the buyer-broker will release you from the contract. However, if you purchase a home or property that this agent showed you or told you about while the contract was in force, you could still be liable to pay him the commission even though you are purchasing after being released from the contract.

    If the agent will not release you from the contract, try speaking with his employing broker.
