How to Obtain One

In order to get a civil court judgment, a civil suit must first be filed with the clerk of courts and the process of court proceedings must be followed.

Execution

In some cases, the judgment is for monetary damages and the defendant refuses to voluntarily pay amount ordered. The plaintiff can then ask the court clerk to issue an order of execution. This order allows the sheriff to seize the defendant's property and sell it at auction to satisfy the judgment. The plaintiff may instead order a lien. A lien allows the party to hold property that may be used for the payment of the judgment.
