An agent for service process, typically known as a registered or statutory agent, is a person or entity that will accept legal documents on behalf of a person or company.
Significance
To commence a lawsuit, a person must be served in the correct jurisdiction. If a defendant does not reside in that jurisdiction, a registered agent must be present to accept documents on their behalf.
Function
A registered agent will sign and accept all documents presented by the process server and forward the legal documents to the defendant.
Requirements
A registered agent may be an entity or individual, as long as the agent has authority to transact business in that state. Each state has different requirements for registered agents.
What is Service of Process?
Service of process is a term used to describe a legal notice being handed over to a person or company. Most notices require personal service of process where a summons also accompanies the notice.
Examples
Typically, personal service of process is served on a registered agent when a company or entity is being sued. An agent can also accept service of process in divorce matters such as a petition for divorce and child support collections.
