Seeing as how expensive trial attorneys have gotten several guilty parties set free (often on technicalities like bad police work), and since innocent people are jailed all the time (as new DNA evidence is finally proving), I think the answer is that it's still harder to convict a guilty person than an innocent one -- and a talented (usually experienced and costly) trial attorney is in the middle of the former's case, and not the latter's case.

logically, it should be truth. however, it is incredibly unfortunate that the size and lack of space in one's wallet matters more.

For sure, the money or how popular the attorney is. I'm not even sure the attorney has to have any ability, just be popular to a favored judge.
