  • According to Guy Lemire at TheCanadianEncyclopedia.com, Canada models its probation system after the system in the United States, giving offenders a second chance for rehabilitation and to avoid time in prison.

    History

Lemire credits John Augustus, a Boston cobbler, for establishing the probation system that eventually spread to Canada. In 1841, Augustus requested the custody of a drunkard in lieu of sending him to prison. As the first probation officer, Augustus counseled 2000 men.

    Jurisdiction

Each Canadian province oversees and operates its own probation system, employing probation officers to work with the court system to protect citizens while rehabilitating offenders.

    Requirements

The court mandates offenders meet periodically with a probation officer and attend drug or alcohol rehabilitation meetings if needed, reports the Yukon Department of Justice (YDJ). Mental health facilities exist for those who need them, and restitution and community service often are part of the probation process.

    Time Frame

One to three years is the most common time span for probation, according to the YDJ, but more serious or repeat offenders may receive up to five years. Judges also can reduce the time of the probation.

    Benefits

Probation in Canada reduces the cost of incarceration for low-risk offenders and ensures room in prisons for high-risk offenders, reports the YDJ.
