  • Driving under the influence (DUI) penalties vary not only by state but by county as well. A third DUI conviction has a large penalty attached to it.

    Enhanced Penalty

    DUI convictions have a somewhat standard penalty associated with them, but there are aggravating factors that can include an enhanced penalty. Such factors include a child in the car (under the age of 14), speeding, driving on a suspended or restricted license, accidents, or high blood-alcohol content (above 0.20 percent).

    Jail Time

    A third DUI in California requires a minimum 120-day jail sentence which may be converted to house arrest or rehab. Most counties will require you to serve at least 210 days in jail. Some require one year.

    Probation

    You will be required to be on probation for three to five years.

    Other Penalties

    You will receive a minimum fine of $1,800 to $2,800 and face a suspension of your driver's license for up to three years. You will also be required to attend DUI school for 18 months.

    Other Factors

    Some other factors that will be taken into consideration during sentencing include the blood alcohol level of the driver, previous convictions, if a minor was in the car, whether the vehicle was private or commercial, other moving violations while DUI, whether there was an accident, property damage, a death as a result of DUI, and the legal drinking age and the age of the driver.
