In Louisiana you have to file for a divorce to be legally separated; living apart isn't enough. I don't know about in NC. Here you file for a divorce and you cannot live together or have sexual relations for 6 months in a row. At the end of the 6 months you can finalize the divorce. If at any time you live together or have sex then that is considered reconciliation and you'd have to refile and start all over. All property bought and sold during the time of the 6 months is not considered community property; only the property acquired and/or sold during the marriage is.
