Racism is considered litigious when you have two different races that are in the same circumstance and have conducted the same acts (right or wrong)...but that only one of the races is met with am award or disciplinary action. There must be clear and present deferential treatement. If the teacher has been subordinate, it's racism if other white teachers were fired for the same infractions. There must be differences in races and differences in treatment.

It is a gross missuse of Affirmative Action. It's happened more than once. If there is a case where someone else of any race was fired for the same offense(s), you have grounds for a suit.
