  • If there was a crime, report it to the police! Also you could get the attorney general's office of your state involved - consumer protection division. But police reports need to be on file and record first by several people preferably, for you to have much evidence of anything.
  • As a member of the HOA you are entitled to go to a meeting to present your case. The HOA President is also a member and a voluteer. The HOA members can request that the board replace the President because of the crime comitted. Otherwise you can sue the board for not taking action. This should get their attention and action.
  • In Florida - your HOA Board is governed by your Covenants and other recorded or published documents, AND Florida Statutes Chapter 720 specifically. The "crime" you say the Pres. committed should be dealt with as both answered above - #1 if it is a criminal act - call the local police and file a report. Have yopur proof handy - words do not go far. The problem is - if it something the Pres. did against Slorida Statute or your Governing Documents - it is "civil" in nature and not a criminal act. You have to hire an attorney and sue him in county court. So - what was "the crime committed on your property"?
