  • Is there anything in your HOA handbook/guidelines? One association I know puts a lien on the home that is behind. Then they cannot sell or second mortgage the home until it is paid off.

  • Ya' know; I have NO sympathy for HOA's . They end up being little Dictatorships. In this day and age , with the economy like it is ... and people losing their jobs , then their homes ... struggling t put groceries on the damm table to feed their families ... I would think there are a lot more worries than a HOA dues ... You can take them to court ; BUT ... you can't make people PAY IF they just don't have the $$$$$ to PAy with ...
  • You can place a lien at your local Register of Deeds; the idea is that a lien would prevent them from mortgaging or selling. If you are a Condo, the laws are typically written (here in Mich) that you can Foreclose (similar to a bank foreclosing on a Mtg) on their unit. Then you'd have a unit to sell. Consult a lawyer, but you can add the lawyer fees onto the lien.
