Good question. I am a manager at a call center, so I frequent questions such as these to my HR department. The difference is if the are exempt or non-exempt status employees. A non-exempt employee is paid an hourly wage, not a salary. If your employee is paid an hourly wage, and they "punch a clock" to keep track of the time they are at work, then according to federal law you must pay them overtime wages for anything over 40 hours. However, if one of my employees does not "punch a clock" they will never be paid overtime, regardless of how much they work. This is because an exempt employee's wages is already determined, regardless of how much time they work. Searching the web for "exempt" and non-exempt" should provide more detail for you. Or call the department of labor, I'm sure they are friendly people :)

It depends on if the emploee is salary or hourly. Was that person hired as salary? If that is the case I think it is ok. but if they are not they must be paid overtime wages.

I was hired to work a 45 hour work week and do not get any overtime. I was told that my salary would be based on a 45 hour work week. Unfortunately, that has turned into a 55 hour work week, so I am looking to change jobs. Everybody needs to have some sort of life outside of work. So my answer is yes with a reccommendation to make sure they don't end up working a lot more than that or they will get burned out and want to leave.

They can do whatever you let them get away with. This is a slave labor country these days. There are no GOOD jobs in the USA. They were all eliminated thanks to the corporate run government. If you want a better job, you have to work for yourself. File Exempt for all taxes and avoid lawyers, IRS agents, and most other paid slave drivers.
