Should laws be followed strictly without flexibility or are they guidelines that allow for the application of common sense?

    There SHOULD be 'flexibility' in our court system...thats why there is mitigating circumstances ( this goes in the defendants favor.) And Aggravating circumstances. (This makes it tougher on the defendant.)

    Laws need flexibility because no one situation is the same as the next. That is why I have never supported mandatory minimums. If some judges do not show good common sense when passing judgment, kick 'em out,don't take away the other judges' ability to do their job as they see fit.

    It all depends on the situation. That's why we have Judges. To hopefully mete out Justice and to see the difference between the Spirit of the Law, and the Letter of the Law.
