The USSC was deferential to Congress in its' opinions regarding it taking back the health insurance industry, so, it could still happen. If insurance companies successfully lobby for inter-state competition, then they'll be giving up their exclusion from the Sherman Act. The public option is almost as naughty a topic to discuss on Capitol Hill as the Senator's mistresses.
