  • Yes, HOA's use attorney's and work with state counties to implement their rules, they cant just come up with something and force the community to do it without it being approved. I would dispute it at your next HOA meeting if you are against it. They will be forced to prolong the issue until its resolved unless you are out voted.
  • If the roads are owned by the Association, then the Association does have the right to restrict their use. In most cases--not all--the roads are owned by the Association in gated communities. Most states do require, however, that the "rule" for which you are being fined for having broken be published before you break it. This is easily accomplished by putting the rule in a newsletter, community website or a simple letter. Though most good Associations publish Rules and Regulations in a handbook if they are rules that are not already outlined in the covenants. By the way--I agree with you HOA in this case. Parking on the street makes the neighborhood less attractive and, therefore, lowers property values. The #1 purpose of the Board of Directors is to promote an increase in property values in your neighborhood. Remember this when you make a profit on the sale of your house.
