There isn't a formula in my state. It's up to the judge's discretion. He considers your lifestyle and what the salaries actually are. If you make minimum wage and your husband made 2.5 times that, you may get little or no alimony. However, if you make $50,000 and he makes $150,000, you may get an alimony settlement, which sometimes includes tuition for you to go to school, etc. The judge does not want the children's lifestyle to have to change tremendously. You need to talk to a family attorney in your state to get a real idea.
I don't know what state you live in, but consider moving and filing in FL. You can always move after the final. If you file in Fl; it will be decided there. Clearwater, FL is very sensitive on women getting support that is needed. Many Attorney's will take your case and collect fee's from your husband. The stress from him causing you to move and being unable to work will increase the amount you receive. Consider living with a guy an d keep in mine that this district in FL will not consider cohabitation as it strictly considers on a need basis. ( if you were in like Miami then that district would rule on cohabitation) Don't mention your residence or arrangement. Also consider filing a restraining order. Ask for permanent and lump sum, you should be set for life.
Florida law considers the need that you request is needed. Your financial affidavit will be the deciding factor.
he is wanting custody of our 15 yr old girl, and letting the 18 yr old high school graduate, live with me, I am used to living on 3200.00 / monthly plus my additional 1200.00 I was making, now i am unemployed, he wants me to move, and pay for the rent on my place , and pay to fix my car that is having mechanical problems, i don't have barely enough money to pay for my lawyer, how the Hell do i pay for all this by myself, when I have MS and our son ,18 has diabetes, HELP!!!!????
That's a decision for the judge. If he gets custody, any alimony you get would increase your child support obligation.
Each of the lawyers present their calculations to the judge and the judge uses his discretion when he makes the alimony order.
