Genrally, one person, that is party to the conversation is allowed to record the conversation without the other's consent/knowledge. Of course, the legal authorities are allowed to do it with a court order.

Your question is too vague. It is legal to record a conversation in all states without a person’s knowledge. This only changes when there is an expectation of privacy.

the law is, as long as one person in the conversation on the phone is aware of the recording, then it is legal.
