  • The fact that the violation was "consensual" is of no relevance. A restraining order is not a contract between the abuser and the victim; it is a court order. The victim has -no authority- to modify the terms of the order without going to court. In Ohio, a person who violates a restraining order can be fined up to five thousand dollars. They may also be found to be in contempt of court and imprisoned.
  • If you live in Gallia County it would probably mean lunch in the jail. We are now going to court for a third violation of a Criminal Protective Order and the secretary from the Prosecuting Atty office tells me he probably wont get any jail time because he has not been convicted of a felony!! Go figure!
