  • Ultimately, it's up to the judge. In Pennsylvania, a stepfather won custody. The problem against him is that he wasn't married to her. Even if he was the father, he still would have no parental rights until granted them by a court. Only Arizona grants single fathers rights similar to married fathers. He may need to do a case law review for your state to see if there's any other decision in this area. He could pay a paralegal or law student to do the research.
