No, because some people have been separated and are going through a divorce process, and a person having sex with another and being punished just because a paper isn't finalized is the most asinine thing I have ever heard of. So then what about people in good standing marriages? Still no, in my opinion, because some people really feel they are in love with another and may want to start a new life with them, so essentially we are punishing people for their emotions, and that's bullshit to me. Even people with persistant sexual deviancy, no. Sex is sex, and if you don't want to be with someone, there are already measures to get them out of your life. It's already bad enough we have to rob the other person during a divorce, but throwing them in jail as well, that's just revengeful.....

It has been illegal and that causes problems all its own. Divorces used to be accompanied by grainy black and white photos of people skulking into hotel rooms, the more to get a bigger cut of the assets. . It wasn't pretty.

(If you mean adultery in the sense of violation of marriage vows, rather than pre-marital activities) Its arguable, but probably not very. If I were king and did something like this it would probably be to enact statutes decreasing property allotted in a divorce to any party proven to have committed adultery within the last x months of the marriage (and therefore believably contributing to the dissolution). I suppose you could also fine the 'other woman' (or man), but I would be hesitant to do that I think. Its kind of a touchy idea though I think.

I think that in the legal part of the marriage process both parties should have to agree on the "cheating" clause..... whether or not they both have to agree to it or not is up to the couple..... "I (swear)/(affirm) that it (is)/(is not) acceptable for me to committ adultery"

No. This is an issue of morality, which the government cannot legislate. It's a private matter between the persons involved and it should be handled by them and their religious leader, if any.
