The law will sometimes excuse an act that might be otherwise punishable when there is what is called "necessity." An example would be you got lost hiking in -30 weather. You come upon a cabin where no one is home. You break into that cabin to save your life. Will you charged for burglary? No. You must however pay for any damage you did and for any goods you used. I answered this from a legal perspective because you have it the legal section. I'm not sure you weren't questioning from a moral perspective.

it depends honestly if in a store yea but if your takin from a person no because they've got it cause they need it but at a store they have more but its not right

Only if your survival depends on it. For example, stealing a loaf of bread since you haven't eaten for a long time. That does not mean that you don't owe the person you stole from for what you took.
