If you already have custody of him he can't take him, that would be kidnapping. For him to gain custody he would have to go before a judge and prove he would be the better parent. Possession is 9/10 of the law, you have him so don't let him go.

He cannot legally decide to take your child away. He would have to win custody in a court of law. Pretty much the only way he could do that is to prove that you are unfit to care for his son. Since he has not put any effort into raising him (except money) it would be difficult for him to convince the court that he is a better parent than you.

Paying child support has nothing to do with custody. The issue of who has custody is a matter that has to be determined in court. If you do not have a court order giving you custody, the simple fact that he is living with you will not equal the power of a court order. Make sure you have a legal, court order custody document, and the Dad cannot take your child away.
