  • If there was only one killing then you could not be convicted of all three. However, if the prosecutor has evidence to support all three causes of action, then they can bring them all and let the jury decide. Second degree murder is a lesser included offense of first degree murder. What that means is that if you are guilty of first degree murder, then you have also met all the elements of second degree murder. Though you still can only be convicted of one.
