  • I believe that if you reported the crime within two years of its occurance, then the statute of limitations for prosecutions is extended from the normal five years to ten years instead. There may also be an extension if you were under the age of majority (18 probably) when the crime occured. Your main obstacle will probably be evidence. If you are serious about proceeding then you definitely need to consult a criminal attorney from the region where the crime occured. Don't rely on what anyone tells you on the Internet. If you are having persistant thougths about this memory, I hope you talk to a therapist. At the very least I hope you write about it in a private journal, which forces you to confront your feelings. You might want to try writing with your non-dominant hand (left, if you're right-handed). You'll have to trust me on that last one.
  • When I was young kid there was a retarded(or close to it) kid that asked me to get naked with him. I said no and that was the end of it. And I never associated with him again. (Of course, I was raised to be a SOB) I have been a little torn now and then. Do you later in life report a retarded kid for something that never happened - cause it didn't with me. I suspect it will at least happen with some kid. I do not know what happened to him, as far as I know he is dead and gone. This is my advise. If it happened - report the guy to protect others. Your older now and it seems came out if it so your battle should be over - but you do have an obligation to others. Who cares about whether or not he sees jail time, you should be protecting - that is your responsibility - just like it probably was the responsiblility of others when he was 24.
  • 1. Get counseling for yourself, totally apart from the criminal justice system. 2. Contact your local rape crisis center hotline and talk to them about this. They will know your local law, and can tell you if the statute of limitations on the assault started "tolling" (counting) from the day of the assault, or from the day you turned 18. 3. Ask them for their advice on how and where to best report this person, so that if he assaults someone else, you can testify at his trial for that assault. 4. Ask them also for their advice on what can be done to stop him now. For instance, were you his babysitter? Does he have teen daughters?   • He may not be able to be charged criminally anymore but you can take him to civil court. It would get his name out there for people to see and perhaps stop him from doing it again. They do it to priests all the time
  • Wrong, he most definetely can be charged with child rape. First, what kind of force was used against you, when the rape occured? Do you remember the date, time and location the rape occured? if so, write down all the details in diary form. Was there a police report made at that time? if not, one will have to made. in order to achieve this, make an appointment with your local district attorney's office. be preprared to tell it all in your office visit.
  • It's going to be a hard sell. Even if you get a sympathetic DA, they cannot bring charges without some evidence. Remember the DUKE rape case ? They went hard after those guys on a false charge and got burned bad. Bad things happen to us, when we don't cause them. Sometimes, counseling can help people deal with the Trauma, I have been told. You are really close to having it under control, I think. You recognize the PTSD for what it is. You know that you would never allow it happen again, precautions would be taken. You know what and why, so you can recover. You will use this as something to grow on, rather than let destroy you. You know not to allow the hurt to keep hurting you. Find a stranger to hash it out with if you cannot face someone you know, but you need to work it out of your system. Or at least diminish it.
  • There isn't any statute of limitation when it comes to Rape. If you were under age, as you say you were just 16...then I think he can still be prosecuted...he should've known better ! It happened to me when I was 17...there were two of them. About a year after it happened, I was in a restaurant,and I saw one of them again ( I actually heard him first ) I turned around, and when I saw him...I ran out of the restaurant and kept running until I couldn't run any more. I was scared to go anywhere for a long time after that.

  • Depending upon where you lived, he could be guilty of statutory rape. I hope you have some older man brother who can kick the crap out of him.
  • Just adding to what ogreford has said. You can still take him to civil court. IF you can handle the emotional trauma of a full-blown trial. . If you reported the crime within the statute of limitations, then there should be some evidence that could be used. It's terribly important that he be punished in some way, even if only to have it made public so that he would be branded for what he is. Sheriff-Raff has a good idea; get someone to beat the crap out of him. I'll do it for free.

  • the laws of each state vary for statutory rape....but, i am really sorry that you had to go through all of that.......
