Capital murder is any murder in which the possible penalty is death. Laws vary by state on what those requirements might be. Second degree murder is an unlawful killing with malice aforethought. This means you killed someone and you had the intent to kill, or the intent to cause severe bodily harm, or the killing occurred during the commission on an inherently dangerous felony. First degree murder is the same as second degree murder but with some aggravating factor. First degree murder is a creature of state, and therefore the aggravating factors vary by state. But a common aggravating factor is a murder that involves premeditation. Most states do not have a third degree murder. If your state does, my guess would be that it is what other states call voluntary manslaughter.
