What can you do to ensure that you do not get turned away at immigration in the USA if you have previously overstayed your holiday visa? Is there any way they can know that you did if your passport was not stamped on the way out of the country?

    Contact a US Embassy or Consulate in your home country for the definitive answer.

    Since 9/11 passport control has gotten more stringent. If there is a record of you entering the US but not leaving at your appointed time, then you're on a computer log somewhere. Now, if you show up in your home country and apply for a holiday visa to the US, they will look you up and see that record. You may be able to explain it away as human error on the ICE agent's part when you left the US (forgot to stamp it, etc), but that's a maybe.
