  • I would fight it in court. The proper thing for him to have done would be to call an 'on-duty' officer and have him pull you over. I don't think officers can write tickets or conduct other normal police activities (short of helping in emergencies, etc.) while off-duty. I'd say you have a good chance.
  • First of all, you're right not to admit to anything. Make them prove their case. As far as Geek's answer, you'll be hard pressed to find a Chief of Police who is ever considered Off-Duty. If he's paid a salary (as opposed to hourly), he's considered On-Duty 24-7, and as such, can pretty much do as he pleases. Depending on the details of the cite, he doesn't necessarily have to write you at the time he witnessed the violation. He's allowed to do it later, again depending on the facts.
