  • You can buy a firearm from a commercial dealer (01 FFL holder) if you can answer the questions on a BATFE Form 4473 and not have any disqualifying answers. The Form 4473 does not ask if your license has been suspended. You are NOT eligible to buy a firearm from a FFL if any of these are true: 1 - You are not the acutal buyer (strawman purchase). 2 - You are under indictment or information in any court for a felony, or any other crime, for which the judge can put you in jail for more than one year. Note that the key here is INDICTED, not charged or suspected. Indicted means a grand jury returned a true bill to the charges filed and the case can proceed to the petit jury and criminal convictions. 3 - You have ever been CONVICTED for a felony, or any other crime, for which the judge can put you in jail for more than one year, even if you got a shorter sentece or probation. 4 - You are a fugitive from justice. 5 - You are a drug user. 6 - You have been found mentally defective or committed to a mental institution. 7 - You are subject to a restraining order stemming from domestic violence calls. 8 - You were dishonorably discharged from the military. 9 - You have been convicted of domestic violence (Lautenberg Amendment). 10 - You have renounced your US citizenship. 11 - You are an illegal alien. 12 - You are a non-immigrant alien (student visa, etc). The first 2 DWIs are Class B misdemeanors. The 3rd DWI is a 3rd degree felony. All 3 DWIs have a mandatory license suspension requirement. If you are only on DWI #1 or #2, you are still eligible to buy a firearm from a FFL.
