  • When he pleaded guilty his record is forever marked as a sexual offender. Never plead guilty or no contest for something you never did...it means you are on paper...and it follows you to your grave....
  • Since he pleaded guilty, I don't think there is anything that can be done now.
  • One step at a time: >> A very promiscuous girl... This is (1) a matter of opinion and (2) irrelevant. The girl is not on trial to defend her honor. Only your friend is (was) on trial. >>I'm 99.9% sure he didn't. Only he and the girl know. Unless you were a witness, then this too is irrelevant. >>He couldn't afford a private attorney, and the court appointed lawyer didn't help him one bit. This is a real problem with American justice. It's far better to BORROW the $$ and hire a REAL ATTORNEY. >>He was forced to plead guilty to avoid jail time. a) He wasn't "forced"; b) YOU DON'T KNOW if he would have been found guilty and sentenced to jail. That's just somebody's guess (his, yours, or the public defender's). If your friend had pleaded not guilty and fought the charge, he might have been found innocent and released. Repeat: a. He was NOT FORCED to plead guilty. b. He might have been found innocent. >>What can he do? He's already done it. Now he's dealing with the consequences. Here is a likely scenario, IMO, based on a careful reading of your own question: Your friend (like you) judged the girl "promiscuous" and figured he could get away with a little force. He did not get a away with it. I wasn't there. I'm not a witness. But based on what you have posted, I think your friend was guilty. Moral: Don't rape girls, even if you think they're "promiscuous."
  • The only way to get out of the verdict is to prove ineffective assistance of counsel. However, depending on the evidence against the accused, a plea to avoid jail time may have been the best advice your lawyer could give.
