Really depends on why you were evading. You did something to get his attention, then left the scene. What you did was the real infraction, not necessarily the leaving part. "Evasion" is usually a misdemeanor that the officer can enforce or drop. It's what you did initially that is the problem, evasion is secondary. You don't get jail time for evasion; maybe overnight detention at most. Unless you have something outstanding...
