I would need to know the facts about their employment. You can only be an independent contractor if you are, in fact, a contractor. The California Supreme Court has set out a list of factors (called "Borrello factors after the case that creaetd them) to use to determine if someone was an employee or a contractor.
My friend is a plaintiff in a lawsuit, and says she is legally not allowed to miss court.Is this accurate? Can one be legally forced to sue?

You're reading The Orange County Register is firing their delivery contractors because they filed a case action suit against them. They claimed that the OC Register was simply avoiding paying them employee's benefits by making them contractors. How would you rule?
