In most places common law marriage is not legally binding specifically when it comes to social security, pensions, retirement plans, property ownership, taxes. If you have been with someone for 50 years, share all the bills, combined non-retirement investments etc...when one passes away assets will be allocated as though not married. The survivor will not receive the deceased social security (if it was more than the survivors own). If they were married the survivor would be eligible for the higher soc sec.
