Help answer this question below.

Wells fargo hired a repo company to get my truck can they enter onto my property if asked to leave also can they speak to my neighbors what legal rights do i have

    A 'repo' company has the right to enter your property to retrieve their goods; it is not considered trespassing. (By the way, in order for almost any trespassing case to be applicable, you must have a no trespassing sign posted. And no, you can't go back and post it after the fact.)

    They, as well as the bank, can speak to whomever they need to to gather information. Once you stop making payments you are guilty of breach of contract; your "rights" at that point, with regards to the vehicle and anything related to it, are minimal. Give up the truck - it's not yours anymore. sorry

    EDIT: BTW, I have worked for law firms and am a paralegal, so whoever gave the negative rating is incorrect. You may not like what I said, but with regards to ANY repossession, it's the truth. Once it goes to repo, it is not yours. period.

    • what legally do i have the ability to do to get it back ive heard they have to hold it for 10 days also if i file chapter 13 will they work with me even though its in repo status

    • You need to contact the company that holds the loan on the car. Some will work with you, whether you are in bankruptcy or repo or not. It is at their sole discretion, however. Be up front and honest about why you fell behind, and what you intend to do to begin paying again. If you get nowhere, ask to speak with a supervisor - right then and there. The longer you wait, the worse it looks for you. Good luck to you!! :-)

    • it depends on the state and the contract. I just had my car reposessed today. Washington state and contract both say I have 12 days to re-instate the loan however, I will be suing them as I'm not late with payment on the loan I have just refused their COMPLETE disregard for the fact that I have full coverage insurance with Geico and they keep putting this f'in Balboa "insurance" on my bill to soak me for another 100 dollars a month. In fact, I'm really taking this up with the government since we now own the banks outright. I am fortunate enough to have the means to sue them and get the Senator who signed off on their bail out on their ass and this is happening. They basically stole the car so they will be paying me back for what I was willing to let slide before - their fake insurance that doesn't pay claims (the Wells Fargo repo department told me that Balboa doesn't pay for claims - they've admitted it) and I've NEVER had a single lapse. Google Wells Fargo Balboa Rip-Off Report and read all of this for yourself - so many scams out of this junk ass company. It's getting paid off quick!
