  • I don't necessarily agree with it, but in the end, it is a cost benefit analysis. It also is an evidentiary issue. How strong is the prosecution's case? If you were a prosecutor and didn't have a ton of evidence, would you rather see the defendant go free or do 25 years or do the life sentence he deserves?
  • Why do you think it is controversial? It does not make sense to hold a long expensive trial when the only purpose is to have the formality of a trial. Moreover, it is not possible to prosecute every defendant. We only try about 2% of cases, and our judicial system is still overtaxed. Imagine if we had to try 100% of cases.
